New Regulations on Supervision of Trademark Agents released

These days, the Trademark Agency Supervision and Management Regulations (hereinafter referred to as the "Regulations") was released, which is an effective way to improve the intellectual property agency management system and improve the standardization of supervision.

 

The "Regulations" further regulates trademark agency, including the stipulation of the basic principles of trademark agency business, the obligations to be performed, and the publicity of the basic matters of the agency, and demanding trademark agencies to establish and improve the business management system and business file system, and strengthening the professional ethics of employees and vocational discipline education.

 

For the "Regulations", the regulatory means have been enriched, the coordination and cooperation mechanism between the market supervision department and the intellectual property management department have been improved, such as information sharing, investigation and handling situation notification, and business guidance, and the relevant regulations on trademark agency supervision have been refined.

 

The "Regulations" improves the legal liability for trademark agency violations and strengthens legal deterrence. Combining with practice, it details on the trademark agency violations listed in the Trademark Law of the People's Republic of China and its implementation regulations provisions to enhance operability, clarifies the illegal situation of engaging in trademark agency business through the Internet. Meantime, it stipulates the supervisory responsibility of the intellectual property management department, as well as the disciplinary requirements and accountability of personnel engaged in trademark registration and management.

 

The "Regulations" will come into effect on December 1, 2022. The State Administration for Market Regulation and the CNIPA will take the opportunity of the release and implementation of the "Regulations" to continue to strengthen the governance and supervision and management of the trademark agency industry, guide trademark agencies to operate in accordance with laws and regulations, promote the high-quality development of the trademark agency industry, and maintain standardization, transparency and fairness, clean and honest trademark registration management order.
