Courts at all levels across China conclude 490,000 intellectual property cases in 2023

The Supreme People's Court work report shows that in 2023, courts at all levels across China conclude 490,000 intellectual property cases, up 1.8% over the previous year. There are 319 cases involving issues of punitive damages, a year-on-year increase of 117%, and the amount of compensation awarded was 1.16 billion yuan, up 3.5 times over the previous year. Cases of the "melamine" invention patent and technical secret infringement were heard. Based on the infringer being ordered to compensate 218 million yuan, a comprehensive settlement was achieved during the execution. The infringer obtained a license to use the patent and the rights holder was finally compensated 658 million yuan, setting a new case record of domestic intellectual property rights. In addition, the report also mentioned the achievements of curbing "Fishing type Uygur power", guiding "unicorn" companies to resolve patent disputes, building a good environment for the protection of film intellectual property rights, and strengthening the protection of military-related intellectual property rights.
In terms of the report, in 2024, the people's courts will strictly protect intellectual property rights and promote the transformation and application, serve the development of new quality productive forces under the law; deepen the "three-in-one" reform of criminal, civil, and administrative trials in intellectual property and other trial areas; strengthen training reserve of talents for professional trial in the foreign-related, intellectual property and other fields.
