After a year and a half of global legal battle, the patent dispute between Samsung and China Datang Mobile has finally come to an end.

The dispute began in early 2023, when China Information Technology Co., Ltd. issued an announcement regarding a lawsuit filed by its subsidiary. The patents involved include specific technologies in the field of communications like those related to data transmission and signal processing.

The charge is based on Datang Mobile's research and development achievements and intellectual property rights claims in the relevant technology areas. Meanwhile, Samsung quickly counterclaimed against Datang Mobile in the United States, attempting to claim that Datang Mobile's patents were invalid. The two companies

engaged in a legal battle on this issue, with Samsung arguing that the technology utilized in its products was independently developed and differed from Datang Mobile's patents.

In April 2024, the Munich Regional Court in Germany made a first-instance judgment.

During the trial, both companies submitted numerous technical evidence, expert testimonies and market analysis reports. A professional team organized by the the court studied and evaluated the technical details of the case in question. In the end, the court ruled that Samsung had infringed Datang Mobile's standard-essential patents which are of certain importance in communication standards. The court supported Datang Mobile's claims and granted its injunction petition.

Based on the verdict, Samsung must pay fixed compensation for some of the allegedly infringing smartphones sold in Germany from August 20, 2021, the specific amount of which depends on Samsung's sales data in Germany, the share of infringing products and the contribution of patented technology. At the same time, the relevant models of cell phones on the market need to be handled as required.

However, two months after the verdict, the situation changed. During the effective period of the verdict, Samsung faced certain pressure in the German market. Also, although Datang Mobile was supported by the judgment, but considering a variety of factors, the two parties finally announced a settlement after the negotiation, ending the patent litigation attracting considerable attraction.
