On June 1, 2021, the third revision of the Copyright Law was officially implemented in China, in which the fair use situation was expanded from the original "published works revised to Braille publication" to "accessibility that can be perceived by persons with dyslexia". to provide them with published works”, providing legislative preparations for the ratification and implementation of the Marrakesh Treaty.
In accordance with the Marrakesh Treaty and China's Copyright Law, the copyright owner's exclusive rights such as reproduction right, distribution right, and information network dissemination right shall be limited under specific circumstances. In this way, copyright holders are partly responsible for improving the ability of people with dyslexia to acquire works.
Henceforward, providing accessible format versions of works for people with dyslexia according to the law, including making use of other relevant national works to provide accessible format versions without the permission of the copyright owner and without payment of remuneration, further enriching the work resources accessible for them and reducing the cost at the same time.
The regulations of the Hague Agreement are quite different from those of China's industrial design examination, and the application procedures as well. All relevant departments of CNIPA have been speeding up preparations, and have conducted several rounds of consultations with the World Intellectual Property Organization, and various connections and preparations for the implementation of the agreement have been conscientiously done. CNIPA will equally examine each application with unified examination standards under the provisions of the Patent Law, and give equal protection to the intellectual property rights of domestic and foreign innovative entities, helping create a business environment of marketization, legalization and internationalization with high-quality intellectual property examination work.
