【GE CHENG News】Beijing Intellectual Property Court issues evidence presenting handbook to facilitate litigation for parties in civil cases of computer software copyright

On August 25, the Beijing Intellectual Property Court released the Chinese and English version of the "Handbook of Evidence Presenting for Parties in Civil Cases of Computer Software Copyright" to explain problems on the proof issues involved in disputes over computer software copyright ownership, infringement disputes and computer software contract disputes, and guide the parties for better response to litigation.

 

It’s said in the introduction from Song Yushui, vice president of the Beijing Intellectual Property Court, that since the establishment of Beijing Intellectual Property Court in 2014, there have been nearly 5,000 civil cases of computer software copyright accepted and around 4,000 cases concluded. For solving the difficulty in presenting evidence in relative cases, the court has compiled and summarized common problems in practice based on trial experience, and issued them in a handbook to provide guidance for the parties in the production of evidence and contribution to the development of the computer software industry.

 

The "Handbook of Evidence Presenting for Parties in Civil Cases of Computer Software Copyright" suggests on the responsibility on evidence presenting of the parties and how to present evidence in computer software ownership disputes and infringement disputes, clarifies the contents, efficacy, fulfillment and termination of contract. In addition, it further clarifies the procedural matters of computer software copyright civil cases.
