Online application rate for trademarks and patents in China both over 99%

As of the end of May this year, the online application rates for trademarks and patents have respectively reached 99.45% and 99.43%.

 

The whole process period of trademark registration in general cases has been shortened to 7 months. The average review and trial periods for trademark opposition and rejection review were reduced to 11 months and 5.5 months respectively. The complete disclosure scope online of administrative ruling documents has been expanded, and the total incremental disclosure of patent reexamination invalidation and review decision documents of trademark opposition have been realized. In the first five months of this year, there were 16,000 public patent reexamination invalidation decisions and 217,000 public trademark documents in total.

 

A total of 277 local trademark acceptance windows have been set up across the country, which effectively get through the "last mile" of IP public services. The patent and trademark electronic application system has realized continual optimization, as of the end of last month, the online application rates for trademarks and patents respectively reached 99.45% and 99.43%. To completely promote electronic certificates for patents and trademarks can further reduce the time for the right holder to obtain the certificate.

 

As of the end of last month, a total of 149 trademarks were under rapid examination. In the first five months of this year, a total of 2,918 remote patent trials were conducted; 5 trademark tour examination courts were established, and 41 trademark tour examinations were completed. A shared pilot of patent rights evaluation reports on e-commerce platforms was launched, sharing over 50,000 verification evaluation reports, and handled more than 900 rights filing controversies and disputes. The whole process of patent priority examination online has been realized in Beijing, Zhejiang, etc.

 

In terms of statistics, in the early five months of this year, 89,300 applications for reexamination of rejection were submitted by applicants via the online application system, accounting for 69.14% of the total number of applications for re-examination of rejection, an increase of 5% compared with the same period last year; 53,500 registered applications for non-use cancellation during three consecutive years were submitted, accounting for 86.76% of the total number of applications, an increase of 23% over the same period last year. Meantime, online applications for back-end businesses such as trademark opposition and invalidation have also shown an increasing trend. Both the number and proportion of online applications have nearly doubled in comparison with the same period last year.
