On September 13, China Automotive Technology & Research Center and China Academy of Information and Communications Technology jointly issued the Guidelines for the License of Automotive Standard Essential Patents (hereinafter referred to as the Guidelines).

With the rapid development of the Intelligent Connected Vehicle (ICV) industry, communications and the Internet have shown a trend of integrated development with the automobile industry. There are huge differences in intellectual property protection and patent licensing models in different industries, leading to emerging problems like the license of cross-industry standard essential patent intellectual property rights, and causing more and more intellectual property litigations and disputes in the automotive and communications industries worldwide.

Five parts such as core principles, calculation principles for reasonable license fees, and power of interpretation and declarations are included in the Guidelines released this time, which will accelerate the development of cross-border integration of industries such as automobiles and communications, and protect fair competition in the market.

The Guidelines clearly shows the principle that "each link in the industrial chain is eligible for licenses", which means that companies including parts and components have access to obtain licenses, further promoting the healthy and sustainable development of China's intelligent connected vehicle industry.
