According to the report:
In 2023, the Intellectual Property Court accepted 7,776 technology intellectual property and monopoly cases in total (including 5,062 new cases and 2,714 old cases), and concluded 4,562 cases, with a settlement ratio of 90.1%. In comparison with 2022, the number of cases accepted increased by 25.8%, of which the number of new cases increased by 14.9% and the number of closed cases increased by 31.5%. The average number of cases accepted by judges (new and old cases included) was 140.4; 82.3 cases were concluded, a year-on-year increase of 2.4 cases.
In 2023, in addition to the overall continuous increase in the number of cases accepted by the court, there are also four basic characteristics as follows:
1. Continuous growth of infringement cases. There were 3,222 new civil second-instance substantive cases, a year-on-year growth of 9%, and an average annual growth of 35.3% in the five years. Infringement disputes concerning invention patents, utility model patents, new plant varieties, technical secrets, and computer software have all increased year by year.
2. Significant increase in administrative cases. There were 1,277 new administrative second-instance substantive cases, up 44.0% from a year earlier, which was in sharp contrast to the 31.2% decrease in 2022.
3. Sustainable growth of cases involving strategic emerging industries. There were 1,582 newly received cases involving strategic emerging industries such as new generation information technology, biotechnology, new energy, new materials, high-end equipment, new energy vehicles, and environmental protection, accounting for 31.3% of all newly received cases, an increase of 244 cases from a year ago, the proportion of court cases further increased.
4. The constant reinforcement of the supervisory role and responsibilities of the second instance.
The judgment revision rate of civil second-instance substantive cases was 25.7%. After excluding cases that were revised due to changes in the validity of rights, unified judgment standards for batch rights protection cases, etc., the judgment revision rate was 11.2%, a year-on-year increase of 1.7%. Meanwhile, the remand rate of substantive civil second-instance cases for retrial continues to decline from 3.4% in 2020 to 0.3% in 2023.
