The Global Forum on Intellectual Property Protection and Innovation of the 2024 Zhongguancun (ZGC) Forum Annual Conference kicked off on April 25 at International Center for Science & Technology Innovation in Beijing with the 24^th World Intellectual Property Day’s coming. Beijing Intellectual Property Court releases White Paper on Protection of the Data Industry under Competition Law (in Chinese & English versions).

The White Paper systematically introduces the basic situation and characteristics of cases involving competition in the data industry in the past three years by the Beijing Intellectual Property Court, and summarizes the main methods for protecting data rights and interests.

From 2021 to 2023, the Beijing Intellectual Property Court concluded a total of 339 anti-unfair competition cases involving the data industry, showing an upward trend year by year. The cases mainly involve the Internet industry, software and information technology service industries, smart manufacturing, etc. Among them, new types of unfair competition behaviors such as data grabbing, brush volume and scrambled letters, and traffic hijacking are emerging in endlessly.

It is stated in the White Paper that the protection of competition laws in the data industry still faces huge challenges, which includes the need to broaden the data protection path, the basis for adjudication to be explored and clarified, and the multiple values of operators' legitimate rights and interests, consumer interests, fair competition order, and data industry development to be balanced, etc.
