ASUS and Samsung settled their patent dispute over 5G

On January 8, 2025, Samsung and ASUS Technology Licensing reached a settlement in the U.S. Federal Court in Texas, ending a patent infringement dispute over wireless 5G technology. Before that, ASUS accused Samsung of infringing its 5G-related patents in multiple Galaxy series devices, and Samsung counter-sued ASUS for infringing its Wi-Fi technology patents.

 

According to the rejection notices filed by both parties, ASUS and its exclusive patent licensee Celerity IP LLC agreed to withdraw their infringement allegations against Samsung, while Samsung withdrew its countercharges against ASUS and Celerity. It is pointed out in the notice that the dismissal does not involve a determination on whether the counterclaim is valid, and the specific terms of the settlement agreement remain confidential.

 

The patent dispute started in September 2023, when ASUS and Celerity sued Samsung, accusing Samsung of using its patents involving 4G and 5G wireless communication technologies without permission. The lawsuit stated that ASUS had repeatedly tried to reach a fair and reasonable licensing agreement with Samsung on these patents, but Samsung did not respond, instead it rejected the licensing request.

 

Then Samsung countersued, alleging Asus’s infringement on its Wi-Fi technology patents, specifically patent No. 9,913,313. Samsung pointed out that Asus used the technology in its Zenbook notebooks without permission. In addition, Samsung also claimed that at least one of Asus' patents should be deemed invalid because of the wrong name of inventor and questioned whether Celerity actually had exclusive licensing rights to the patent.

 

Based on this settlement, both parties agreed to terminate all litigation, but the specific content of the settlement and the terms of the license remained disclosed.
