EVE Energy announced on October 18 that it reached an agreement with VARTA Microbattery GmbH (hereinafter referred to as "VARTA”) on the global lawsuit. The agreement stipulates that both parties withdraw all legal proceedings against each other globally. They also agreed to expand common business opportunities and establish a future-oriented cooperative and mutually beneficial relationship. Besides, they began to file applications to withdraw the lawsuit and withdraw the case in the corresponding courts and the Patent Trial and Appeal Board.

EVE Energy and Varta have jointly applied an application to the Federal Court for the Eastern District of Texas in the United States to withdraw the case. The US Eastern District Court of Texas approved the motion to withdraw the case submitted by both parties. The lawsuit initiated by VARTA against EVE Energy in the US Eastern District Court of Texas was officially withdrawn, meantime, EVE Energy and Varta jointly submitted invalid applications to the Patent Trial and Appeal Board of the United States Patent and Trademark Office to revoke the above five patents. The Patent Trial and Appeal Board of the United States Patent and Trademark Office has reviewed and approved the invalidation applications applied by EVE Energy and Varta to cancel the five cases filed.

Since October 2021, VARTA has filed a patent infringement lawsuit in the Eastern District Federal Court of Texas in the United States in terms of the alleged infringement of VARTA's patent rights by some of the button battery products sold by EVE Energy which accordingly filed an invalidation application for the patents involved at the Patent Trial and Appeal Board of the US Patent and Trademark Office, five of the patent invalidation applications were filed at the beginning of this year.
