The patent war between CATL whose two patents were ruled invalid and CALB reverses

The two-year patent war between Contemporary Amperex Technology Co., Limited(CATL)and CALB has reversed.
On the evening of August 3, CALB announced that the CNIPA had issued two "Examination Decision on Request for Invalidation", respectively claiming the "lithium-ion battery" and "positive electrode plates and batteries" invention patent rights owned by CATL are invalid. It is reported that in June last year, CALB applied an application to the CNIPA requesting that the above two patents be declared invalid.
In July 2021, CATL successively sued CALB for infringement of five of its battery patents, claiming a total claim of up to 647 million yuan. CATL stated that the patents involved in the case include positive electrode plates and batteries, explosion-proof devices, current collecting components and batteries, lithium-ion batteries, power battery top cover structures, and power batteries. Besides, the suspected infringing batteries have also been installed on tens of thousands of vehicles.
It is essential that the battery patents mentioned above include the "lithium-ion battery" and "positive electrode plates and batteries" patents, CATL's claim for infringement of the above two patents is 108 million yuan.
In February this year, the Fuzhou Intermediate People's Court issued a first-instance judgment on the patent infringement lawsuit for "lithium-ion batteries" and "positive electrode plates and batteries". According to the judgment, CALB was found guilty of infringement and required to pay CATL 57.1 million yuan in compensation. meantime, it is required to immediately stop selling the infringing products involved in the lawsuit.
CALB declared in an announcement on the evening of August 3 that the results of this review may mean that the previous judgment of the Fuzhou Intermediate People's Court will be invalid.
